Your immigration begins with a strategy, not with a form.
At MMS Law, every case begins with a goal: advancing a career, expanding a business, investing, hiring talent, or reuniting a family. Starting from that goal, we develop the most suitable legal strategy, evaluate the available alternatives, and build a solid, evidence-based case. Because a successful immigration decision begins long before choosing the visa category.
Goal 1
Advance my career
The right path depends on your level of recognition and your horizon. Some lead directly to a Green Card without depending on an employer; others allow you to start working now, with sponsorship.
EB-2 NIW
Green Card · self-petition
Permanent residence for professionals whose work has substantial merit and national importance to the U.S.
Key requirement
Meet the three prongs of Matter of Dhanasar; no employer, job offer, or PERM required.
What decides the case
Connecting your work to a benefit of national scope — being qualified isn't enough; you must demonstrate impact.
EB-1A
Green Card · self-petition
Permanent residence for those at the very top of their field, with sustained recognition.
Key requirement
A single major, internationally recognized award OR 3 of 10 criteria + a merit assessment (Kazarian).
What decides the case
The quality of the evidence, not the quantity: three strong criteria outweigh seven weak ones.
O-1A
Temporary · extraordinary ability (business, science, education & athletics)
Temporary work authorization for professionals with extraordinary ability in business, science, education, or athletics.
Key requirement
Prove extraordinary ability through consistent evidence and secure a qualified petitioner in the United States (employer or agent).
What decides the case
The quality of the evidence, the coherence of the narrative, and a strategy capable of positioning the professional as a reference in their field.
O-1B
Temporary · extraordinary achievement (arts & entertainment)
Temporary work authorization for artists and entertainment-industry professionals with recognition and distinction in their field.
Key requirement
Demonstrate recognition through relevant achievements and present a qualified petitioner in the United States (employer or agent).
What decides the case
The consistency of the evidence, professional recognition, and a strategy that demonstrates the impact and relevance of the artistic career.
Goal 2
Expand my business
Growing in the U.S. requires immigration planning aligned with the corporate structure. The L-1A → EB-1C sequence is the backbone of many expansions.
L-1A
Temporary · intracompany
Transfer of executives and managers from a company abroad to the U.S. operation.
Key requirement
A qualifying corporate relationship + 1 year of qualified work abroad within the last 3.
What decides the case
Demonstrating real executive/managerial capacity — and, for a new operation, a credible growth plan.
EB-1C
Green Card · multinational manager
Permanent residence for multinational executives and managers, frequently used as the next step after an L-1A transfer.
Key requirement
A qualified U.S. employer, a corporate relationship between the companies, and the exercise of executive or managerial roles before and after the transfer.
What decides the case
The U.S. operation already being consolidated enough to sustain a genuinely executive role.
EB-5
Green Card · investment
Permanent residence through a qualified investment that creates jobs.
Key requirement
A minimum investment of US$ 800K (TEA) or US$ 1.05M (outside TEA), with creation or preservation of the legally required jobs, as applicable.
What decides the case
Proving the lawful and traceable source of funds and demonstrating that the investment meets the at-risk capital requirement.
Goal 3
Invest in the U.S.
The United States offers different paths for investors, both temporary and permanent. The most suitable strategy depends on the investor's nationality, the structure of the investment, and their long-term goals.
E-2
Temporary · treaty investor
For investors from countries that have a treaty of commerce and navigation with the United States who wish to develop and direct a business in the country. It is a temporary and renewable visa, without a direct grant of permanent residence.
Key requirement
Treaty-eligible nationality + a substantial investment already committed and “at risk.”
What decides the case
Demonstrating that the investment is real, operational, and viable, as well as defining a long-term strategy, since the E-2 by itself does not lead to permanent residence.
EB-5
Green Card · investment
For investors seeking permanent residence through a qualified investment.
Goal 4
Reunite my family
Every family has a different story. The immigration path depends on the family relationship, the sponsor's immigration status, and long-term goals.
Green Card for Immediate Relatives
Immediate Relative
Permanent residence for spouses, unmarried children under 21, and parents of U.S. citizens.
Key requirement
Prove the qualifying family relationship and meet the legal requirements of the category.
What decides the case
Consistent documentation and defining the most suitable strategy for each family.
Green Card through Marriage
Marriage-Based Immigration
Permanent residence for spouses of U.S. citizens or permanent residents.
Key requirement
Demonstrate that the marriage is legitimate (bona fide) and meet the requirements of the applicable category.
What decides the case
Building, from the outset, a solid body of evidence that demonstrates the authenticity of the relationship.
Removal of Conditions
I-751 · Conditional Residence
Converts the conditional green card into a ten-year permanent residence.
Key requirement
File the petition within the correct window or demonstrate eligibility for one of the exceptions provided by law.
What decides the case
Maintaining a consistent record of shared life and presenting ongoing evidence of the relationship.
Naturalization
N-400 · U.S. Citizenship
Acquisition of U.S. citizenship after meeting the legal requirements for naturalization, following the required period of permanent residence.
Key requirement
Meet the minimum residence period, the physical presence requirements, and demonstrate good moral character.
What decides the case
Planning the ideal timing for the application and reviewing, in advance, the immigration, tax, and international travel history.
